Power of sale is not foreclosure — and in Ontario that matters

Most homeowners use the two words interchangeably. Lenders do not, and the difference decides how much time you have.

No court date protects you

Under the Mortgages Act (Ontario), your lender does not need a judgment before selling. Ontario uses the fastest mortgage enforcement process in Canada. Nobody schedules a hearing you can prepare for.

The timeline in Ontario

Your lender can issue a Notice of Sale Under Mortgage once you are 15 days in default. After serving it they must wait 35 days before selling. That is the entire statutory buffer — from a missed payment to a sold house can be under 90 days.

What actually stops it

Ontario is unusually generous on one specific point: during the 35-day notice period you can normally reinstate by paying the arrears plus the lender's costs — not the entire mortgage balance. That is a far smaller number than most homeowners assume, and it stops the sale.

Three paths that end a power of sale in Wallaceburg

Which one fits depends on your equity, your income, and how many days are left on the notice.

1 Reinstate the mortgage

Pay the arrears plus the lender’s costs within the notice period and the mortgage returns to good standing. This is usually a much smaller number than the full balance.

Best when: you are a few payments behind and income has recovered.

2 Refinance and pay out

A new lender clears the existing mortgage entirely and the sale stops. B-tier and private lenders regularly refinance files in active power of sale. We refer you to a broker at no cost.

Best when: you hold meaningful equity in the Wallaceburg property.

3 Sell on your own timeline

Selling before the lender does keeps the sale price, the closing date, and any surplus in your control. We may purchase directly for cash with no commissions and no fees to you.

Best when: the notice period is short or equity is thin.
