Facing foreclosure in Lakeview?

If you are behind on mortgage payments on an Lakeview home, the Saskatchewan process gives you more room than most provinces — typically 4 to 7 months from first missed payment in total. What matters is using that time rather than waiting it out.

The Saskatchewan process behind an Lakeview foreclosure

Saskatchewan gives homeowners some of the strongest procedural protection in Canada. Under The Land Contracts (Actions) Act, 2018, a lender must obtain leave of the court before commencing a foreclosure action on your home — an action started without leave is a nullity — and must serve notice of the leave application on you and the Provincial Mediation Board at least 60 days before the hearing. Farm land has its own, separate protection under The Saskatchewan Farm Security Act.

The lender needs permission just to start

For homes — not just farms — the lender must obtain leave of the court before commencing foreclosure at all; only purely commercial land is excluded. That is a real procedural hurdle and it buys you time — but only if you use it.

Your three options in Lakeview

1 Refinance

A B-tier or private lender clears the existing mortgage and the foreclosure ends. We refer you to a broker at no cost to you.

Best when: you hold equity in the Lakeview property.

2 Sell on your timeline

Selling before a court sale keeps the price and closing date under your control. Cash purchase, no commissions, no fees from you.

Best when: you want certainty.

3 Cure the arrears

Paying the arrears and costs restores the mortgage. Usually far less than the full balance.

Best when: income has recovered.
